Potters' charges include First Degree Murder

The article printed in last week’s Tomahawk entitled “Mother and daughter charged in Payne, Hayworth deaths,” listed the charges brought against Barbara and Janelle Potter as two counts of Conspiracy to Commit First Degree Murder. However, according to the Circuit Court Clerk’s office, the charges that came down from the Grand Jury also included two counts of First Degree Murder.
According to The Tomahawk’s legal source with The Tennessee Press Association, prosecutors do not have to prove that a defendant was actually present at the scene of the crime to be charged with First Degree Murder, only that they were actively involved in its commitment.
Evidence presented to the Grand Jury will not be available until the trial takes place.
