NOTICE OF TRUSTEE’S SALE WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated March 8, 2004, and the Deed of Trust of even date securing the same, recorded March 17, 2004, in Book No. T192, at Page 336, in Office of the Register of Deeds for Johnson County, Tennessee, executed by Jeffrey Phillippi and Jennifer Phillippi,

NOTICE OF TRUSTEE’S SALE WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated March 8, 2004, and the Deed of Trust of even date securing the same, recorded March 17, 2004, in Book No. T192, at Page 336, in Office of the Register of Deeds for Johnson County, Tennessee, executed by Jeffrey Phillippi and Jennifer Phillippi, conveying certain property therein described to Charles E. Tonkin, II as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Mortgage Investors Group, its successors and assigns; and the undersigned, Wilson & Associates, P.L.L .C., having been appointed Successor Trustee by Wells Fargo Bank, N. A.. NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wells Fargo Bank, N.A., will, on May 13, 2020 on or about 1:00 PM, at the Johnson County Courthouse, Mountain City, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Johnson County, Tennessee, and being more particularly described as follows: Located in the 2nd Civil District of Johnson County, Tennessee: BEING Lot No. 9 of the revised plat or plan of Rolling Hills Subdivision, of Johnson County, Tennessee, as said plat or plan is of record in the Register’s Office of Johnson County, Tennessee, in Plat Book 3, at page 34, and said property being more particularly described by outer perimeter and by recent survey as follows, to-wit: BEGINNING at a point witnessed by an iron pin set in the line of Bill Icenhour, a corner to David Cunningham and being the northern most point of the tract herein; thence, with the line of Cunningham, South 39° 33’ 05″ West, 206.98 feet to an iron pin set in the northern edge of Second Street, thence, with the general northern edge of the roadway and/ or right-of-way of Second Street, South 49° 54’ 16″ East, 99. 56 feet to an iron pin set, a corner to Carolina Tedder (now Mink); thence, with the line of Tedder (now Mink), North 39º 20’ 01″ East. 208.52 feet to an iron pin set in the line of Billy Icenhour; thence, with Icenhour, North 50º, 47’ 23″ West, 98 .76 feet, back to the point of BEGINNING, containing 0.47 acre, more or less, as surveyed by Appalachain Land Survey Company, date of June 16, 1994. EXCEPTING and RESERVING from the above property, in easement fashion, is any part or portion thereof constituting the roadway and/or right-of-way of Valley Drive and/or Second Street. Said tract of land being further described on a plat or plan entitled “Survey for Jack Arnold” dated June 16, 1994, prepared by Thomas T, Grayson, R.L.S. No. 1346, a copy of said plat or plan attached and marked as Exhibit A to that deed of record in the Register’s Office of Johnson County, Tennessee in Deed Book 131, page 659, to which reference is had and made for further description. ALSO KNOWN AS: 273 Cressview Road, Mountain City, TN 37683-4322 This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above-referenced property: JEFFREY PHILLIPPI JENNIFER PHILLIPPI MOUNTAIN ELECTRIC COOPERATIVE, INC. The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time. The right is reserved to adjourn the day of the sale to another day, time, and place certain without further publication, upon announcement at the time and place for the sale set forth above. In the event of inclement weather, the trustee hereby announces that the sale will be postponed for a period of two weeks. In such situations, notices will be mailed to interested parties of record.
