NOTICE OF FORECLOSURE AND SUCCESSOR TRUSTEE’S SALE WHEREAS, PERRY FARMS, LLC, A TENNESSEE LIMITED LIABILITY COMPANY

NOTICE OF FORECLOSURE AND SUCCESSOR TRUSTEE’S SALE WHEREAS, PERRY FARMS, LLC, A TENNESSEE LIMITED LIABILITY COMPANY, by Deed of Trust (the “Deed of Trust”) executed on November 4, 2014 and recorded in Book T284, Page 604, in the Register’s Office for Johnson County, Tennessee, conveyed to William J. Cockett, Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note (the “Note”) described in the Deed of Trust, which Note was payable to the order of HIGHLANDS UNION BANK in installments as indicated in said Deed of Trust; and WHEREAS, default has been made in the payment of the Note herein described; and WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust; and WHEREAS, the Deed of Trust designated William J. Cockett as Trustee for the purpose of enforcing said Deed of Trust; by an Appointment of Successor Trustee dated December 30, 2019, of record in Book T319, Page 136, in the Register’s Office for Johnson County, Tennessee, R. Alexander Johnson was designated as Successor Trustee; and R. Alexander Johnson is therefore designated as Successor Trustee for the purpose of giving this notice and foreclosing said Deed of Trust, and has been directed to take such action by the owner and holder of the Note. NOW, THEREFORE, notice is hereby given that I, R. Alexander Johnson, Successor Trustee, pursuant to the power, duty and authority vested in and conferred upon me by the Deed of Trust, will on the 25TH DAY OF FEBRURARY, 2020 AT 10:30 A.M. at the front door of the Johnson County Courthouse located at 222 West Main Street, Mountain City, Tennessee facing West Main Street, Mountain City, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Johnson County, Tennessee, described as follows: SITUATE in the second (2nd) Civil District of Johnson County, Tennessee, and being all of Tract 2, of SURVEY FOR THEDA STEWART, as the same appears on a map of record in Plat Cabinet 6, Page 143, in the Register’s Office for Johnson County, Tennessee, to which reference is here made for a more particular description. SUBJECT to any easements, rights-of-way, utility and drainage easements, and any other notes shown on the maps of record in Plat Cabinet 6, Page 143, Deed Book D121, Page 419 and Deed Book D127, Page 931 in the Register’s Office for Johnson County, Tennessee. BEING the same property conveyed to Perry Farms, LLC by Quit Claim Deed from D.J. Cecile dated September 19, 2014 of record in Book D 195, Page 832, in the Register’s Office for Johnson County, Tennessee. Johnson County Tax Map: MAP 047, PARCEL 028.01 Located off of Hwy 67 W CURRENT OWNERS: PERRY FARMS, LLC, A TENNESSEE LIMITED LIABILITY COMPANY INTERESTED PARTIES AND SUBORDINATE LIENHOLDERS: NONE THE PREPARER OF THIS INSTRUMENT MAKES NO REPRESENTATIONS AS TO THE STATUS OF TITLE OF THE PROPERTY DESCRIBED HEREIN. The right is reserved to adjourn the day of the sale to another day and time certain, without further publication and in accordance with the law, upon announcement of such adjournment on the day and at the time and place of sale as set forth above. The above described property will be sold subject to any unpaid taxes, prior deeds of trust, all easements and restrictions, the rights of tenants in possession of said premises, if any, prior claims, liens, and encumbrances, matters of record, or any matter that an accurate survey of the premises might disclose and the conditions and requirements of any applicable planning and zoning authority. The proceeds of this sale will be applied first to discharge the costs and charges of executing this trust, including attorney’s fees; next to all indebtedness remaining unpaid and secured thereby, including all indebtedness owing to HIGHLANDS UNION BANK, and next the balance, if any, shall be paid to those legally entitled thereto. Should the highest bidder fail to comply with the terms of the bid at the public sale, then the Successor Trustee shall have the option of accepting the second highest bid or the next highest bid with which the buyer is able to comply.
