MC – SUBSTITUTE TRUSTEE’S NOTICE OF SALE OF REAL ESTATE KNOW ALL MEN BY THESE PRESENTS: That, by the terms and conditions of a Deed of Trust dated January 20, 2009, and recorded in Book T245, Page 923, of record in the Register’s Office for Johnson County, Tennessee, Robert Butler Sullivan, unmarried, Jay Patrick Sullivan and wife, Mary K. Sullivan, Robert Butler Sullivan, II, and wife, Kim Sullivan, did convey in trust to T. Mike Estes, Trustee, a tract of land hereinafter described to secure the payment of one certain Promissory Note in said Deed being incorporated by reference; and WHEREAS, Larry R. Churchwell was appointed Substitute Trustee by instrument of record in Book T326, Page 50, in the Register’s Office for Johnson County, Tennessee; and WHEREAS, default has been made in the payment of said indebtedness, and the owner and holder of said Note has instructed the undersigned Substitute Trustee to foreclose pursuant to the terms of said trust conveyance. NOW, THEREFORE, by virtue of the authority in me vested as Substitute Trustee, under said instrument, I will, on Friday, June 25, 2021, offer for sale and sell, at the Johnson County Courthouse door on West Main Street in Mountain City, Tennessee at the hour of ELEVEN A.M., prevailing time, to the last, highest, and best bidder, for cash in hand, and in bar of the equity of redemption, the property described to-wit: SITUATE in the 4th (Fourth) Civil District of Johnson County, Tennessee, and being more particularly bounded and described as follows, to-wit: PROPERTY NO.1: BEING all of that tract or parcel of land containing 0.829 acre as shown on plat of survey entitled “Property of: Angie Irene Lunceford (L/E) Mark Edward Lunceford (Remainder)” dated December 16, 2008 as performed by Thomas Lynn Snyder, T.R.L.S. No. 2489 of Snyder Surveying, Inc., 156 Doe Creek Road, Butler, TN 37640. BEING the same property conveyed to Jay P. Sullivan and wife, Mary K. Sullivan by deed from Angie Irene Lunceford and husband, Mark Edward Lunceford dated the 29th day of December, 2008, of record in Deed Book 181, Page 333, Register’s Office, Johnson County, Tennessee. Subsequent thereto, Jay P. Sullivan and wife, Mary K. Sullivan executed a Quit Claim Deed to Robert Butler Sullivan, Robert Butler Sullivan, II and Jay Patrick Sullivan dated the 20th day of January, 2009, recorded in the Register’s Office for Johnson County, Tennessee, in Deed Book 181, page 456. SUBJECT to valid restrictions and easements, recorded or unrecorded, including but not limited to Roan Creek Road (Highway 167) and Little Dry Run Road. PROPERTY NO. 2: BEING all of Lot 9C containing 0.61 acres, as shown on plat of survey entitled “Property of Stacy M. Wilkinson” dated October 23, 2001, as prepared by Ricky Lynn Snyder, T.R.L.S. No. 1910, of Snyder Surveying Company, 156 Doe Creek Road, Butler, TN 37640, a copy of which plat is attached as the last page to that deed aforesaid (Deed Book 166, Page 448) as an exhibit and incorporated herein by reference. Said property is a portion of Lot 9 of “The Woodlands, Property of Fred P. Louth”, prepared by Ashe Engineers, Planners, Surveyors, PC dated August 8, 1974, recorded in the Register’s Office for Johnson County, Tennessee in Plat Book 3, Page 110. The above property conveyed SUBJECT TO right-of-way agreement for public roads heretofore executed by Don Lunceford (single) and Johnson County, Tennessee in Miscellaneous Book 2, at page 187, and/or right-of way agreement of Ed Lunceford and wife, Irene Lunceford and Johnson County, Tennessee regarding Roan Creek Road, dated June 26, 1952 of record in the Register’s Office for Johnson County, Tennessee in Miscellaneous Book 2, at page 178. ALSO CONVEYED as an easement appurtenant is a shared domestic supply of water from the well situate on the line between Lot 9A and Lot 9B and which is currently serving the premises through the pipeline which is currently serving the premises along with the right to inspect and repair the necessary pipeline or pipelines for the conveyance of said water to this property. Each well user shall pay a prorata share of expenses of the maintenance of the well as a condition of using same. The Grantor reserves the right to convey water rights to others upon the same condition. SUBJECT to right-of-way for Roan Creek Highway (a.k.a. Highway 2374). SUBJECT to terms and conditions of right-of-way Agreement recorded in the Register’s Office for Johnson County, Tennessee in Miscellaneous Book 2, at page 187. BEING that property, which was conveyed to Robert Butler Sullivan, Robert Butler Sullivan, II and Jay Patrick Sullivan by deed from David C. Walker and wife, Traci J. Walker dated the 20th day of January, 2009 recorded in the Register’s Office for Johnson County, Tennessee in Deed Book 181, page 460. PROPERTY NO. 3: BEING all of those tracts or parcels of land set forth and designated as Tracts Nos. 10, 11, 12, 13, 14, 15, 16, 17, 18, 19, 20, 21, 22, 23, 24, 25, 26, 27, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38 and 39, as shown on that plat or plan entitled “The Woodlands, Property of Fred P. Lauth” prepared by Ashe Engineers, Planners, Surveyors, P.C. date of August 8, 1974 and of record in the Register’s Office for Johnson County, Tennessee in Plat Book 3, Page 110, less and except all of that tract or parcel of land containing 19.29 acres as shown on plat of survey entitled “Property of: Stacy M. Wilkinson” dated November 10, 2005 as performed by Ricky Lynn Snyder T.R.L.S No. 1910, which plat is recorded in the Register’s Office for Johnson County, Tennessee in Plat Cabinet 6, Slide 90 and which property has been previously conveyed by Wolfdog, LLC to Johnson County, Tennessee by deed recorded in the Register’s Office for Johnson County, Tennessee in Deed Book 175, page 166. FURTHER, BEING a portion of that 111.28 acre tract of ground as the same is found and described on a plat map duly recorded in Plat Book 3, page 96 of the Johnson County, Tennessee, Register of Deeds Office. Said map prepared by Ashe Engineers – Planners – Surveyors, P.A. (Bobby Joe Oliver, Tennessee Registered Surveyor No. 525) Reference is hereby made to said plat full and complete description of the property. The above tract subject to a road (Highway 2374) right-of-way across the property as the same is shown on the plat map above referred to see Miscellaneous Book 2, Page 187. ALSO CONVEYING that 50 foot wide easement over and across the right-of-way shown on the aforementioned plat of 19.29 acres “Property of: Stacy M. Wilkinson” recorded in Plat Cabinet 6, Slide 90 entitled “40’ right of way” which easement was reserved by Wolfdog, LLC in the aforementioned deed to Johnson County, Tennessee recorded in Deed Book 175, page 166 recorded in the Register’s Office for Johnson County, Tennessee. RESERVING an easement for a water line for the benefit of that parcel owned by Wolfdog, LLC pursuant to deed from Stacy M. Wilkinson, Trustee dated the 19th day of April, 2002 recorded in the Register’s Office for Johnson County, Tennessee in Deed Book 157, page 832, which parcel has been recently surveyed and is shown on plat of survey entitled “Wolfdog, LLC” dated December 19, 2008 as performed by Ricky Lynn Snyder, T.R.L.S. No. 1910 of Snyder Surveying, Inc. a copy of which plat is attached hereto and incorporated herein by reference. The water line easement shall be over, across and under that area shown on said plat as “water line easement to be reserved”. Wolfdog, LLC reserves the right to lay and maintain a water line within said easement area for the benefit of said 0.405 acre tract shown thereon, their heirs, successors and assigns. BEING that property, which was conveyed to Robert Butler Sullivan, Robert Butler Sullivan II and Jay Patrick Sullivan by deed from Wolfdog, LLC dated the 20th day of January, 2009, recorded in the Register’s Office for Johnson County, Tennessee in Deed Book 181, page 463.
