MC – NOTICE OF TRUSTEE’S SALE WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated July 12, 2021, and the Deed of Trust of even date securing the same, recorded July 12, 2021, in Book No. T334, at Page 251, in Office of the Register of Deeds for Johnson County, Tennessee, executed by David Hemsley, conveying certain property therein described to Walker Title, LLC as Trustee for Mortgage Electronic Registration Systems, Inc., as beneficiary, as nominee for Wintrust Mortgage, A Division of Barrington Bank and Trust Co., N.A., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by Wintrust Mortgage, a division of Barrington Bank & Trust Co., N.A.. NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by Wintrust Mortgage, a division of Barrington Bank & Trust Co., N.A., will, on October 26, 2022 on or about 11:00 AM, at the Front Door of the Johnson County Courthouse 222 W Main St., Mountain City, TN 37683, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Johnson County, Tennessee, and being more particularly described as follows: TRACT ONE: BEING all of that tract or parcel of land set forth and designated as containing 0.29 acre more or less all as shown on a plat or plan entitled “Survey for Mariano and Kathy Lettieri” prepared by Appalachian Land Survey Company, Thomas Todd Grayson, RLS #1346, date of June 14, 2016, attached to deed recorded in Book 200, page 464, Johnson County Registry, which reference is had and made for a full and complete description of the said tract or parcel of land. TRACT TWO: BEGINNING at a point witnessed by an iron pin set in the general eastern edge of the roadway and/or right-of-way of the Roan Creek Highway comer to that tract heretofore conveyed to Hodges and being the northern most point of the tract herein; thence, leaving said highway, south 55°, 14’, 00″ east, 130.80 feet to an iron pin set; thence, south 31’, 30’, 54″ west, 232.00 feet to an iron pin set comer to Potter; thence, with Potter, north 55°, 14’, 00″ west, 143.95 feet to a point in the general eastern edge of the roadway and/or right-of-way of the Roan Creek Highway; thence, with the same, north 34°, 45’, 53″ east, 231.63 feet, back to the point of BEGINNING, containing 0.73 acre, more or less, as surveyed by Appalachian Land Survey Company, date of February 24,1997, and a plat or plan of the same being attached thereto as an exhibit to that deed (being Tract No. 1 thereto, Deed Book 140, page 779), to which further reference is had and made for description. ALSO KNOWN AS: 765 Roan Creek Road, Mountain City, TN 37683 This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. In addition, the following parties may claim an interest in the above- referenced property: DAVID HEMSLEY The sale held pursuant to this Notice may be rescinded at the Successor Trustee’s option at any time.
